Our experience is that EV mode will click off (and go into normal hybrid mode) at around 10-20% of battery charge remaining. That's to protect the battery and make it last much longer. Most people report 25-30 MPH as average top speed in EV mode but there are too many variables in addition to speed to give an real accurate number.

ev mode just makes the car try to stay in ev. you can accelerate harder (but not too hard) with ev mode on without the engine kicking in, drive quietly though a parking garage, etc. but as soon as you accelerate too hard or pass 25mph or the battery is dead, it kicks ev mode off, and stays off. really quite pointless i think.

Heavy electric-only drive and subsequent recharge in stop and slow-go traffic could create this situation, especially if the car had "hot soaked" in the full sun on an open asphalt parking lot just before the event.

There are many reasons EV mode won't be available. The vehicle and the hybrid powertrain must be at operating temp. If you tried when first starting out it will be unavailable. Likewise, if the car/battery is very warm and regenerative braking is reduced or eliminated then EV mode will not be available.
